Step-by-Step Process to Register a Trademark Online in India

Step 1: Select a Unique Brand Name

First, choose a unique and distinctive brand name. You should avoid common or descriptive words because the Trademark Registry may object to them.

For example, a name like “Best Accounting Services” directly describes the service. As a result, it may not get strong protection. On the other hand, a unique and creative name has better chances of approval.

Therefore, before finalising your brand name, think from both business and legal points of view.

Step 2: Choose the Correct Trademark Class

Next, select the correct trademark class. India follows the Nice Classification system.

Goods fall under Classes 1 to 34, while services fall under Classes 35 to 45.

For example:

  • Class 35 covers business management, advertising, consultancy, and trading services.
  • Class 41 covers education and training services.
  • Class 42 covers software and technology services.
  • Class 43 covers restaurant and food services.
  • Class 45 covers legal and personal services.

Step 6: Pay the Government Fee

After filling in the application, pay the government fee online.

After successful filing, the portal generates an application number. You can use this number to track your application status.

Once you receive the application number, you can start using the “TM” symbol with your brand.

However, you should not use the “®” symbol at this stage because registration is still pending.

Step 8: Trademark Registry Examines the Application

After filing, the Trademark Registry checks your application. The officer reviews whether your trademark is unique, legally acceptable, and not similar to any existing trademark.

If the officer finds no issue, the application moves to publication.

However, if the officer raises an objection, you must file a proper reply within the prescribed time. Therefore, you should regularly track your application status.
